A rural market hotel in California received a phone call from the police asking to hotel room doordo a welfare check on a guest. It was requested of the police by the child’s father that this be done, even though the child was 18 years old. When the police arrived, the manager of the hotel lied to the police at the request of the child and said that the guest had checked out. It turned out the guest was depressed and had plans to kill herself. She had a do not disturb sign on her door, and the staff never even checked to see if she was ok for three days. Unfortunately, she did kill herself, and the hotel was liable for lying to the police. They had no manual for staff on handling a police request for a welfare check (not that it is not common sense) and had no right to interfere with police business.

An iconic, high-rise hotel in Los Angeles was sued for millions of dollars for allegedly serving piping hot coffee via room service. As it turned out, the room service server did nothing wrong. He was called to deliver the coffee to a room. When he arrived, nobody responded to his knock on the door, but the door had been left open for him to leave the coffee. Unfortunately, the guest had left their 1-year-old child with access to the parlor room where the coffee was waiting for the mom, who had taken a quick shower in the bedroom. The child accidentally spilled hot coffee on her face and ended up with permanent scars. I represented the hotel and proved via testing that the coffee was served at the proper temperature, the server followed protocol in leaving the coffee, not knowing there was a child present and the event was simply a bad accident. The most critical thing was interviewing every employee to ensure they were all aware of proper protocol—calling out to the guest, leaving the coffee, leaving a short note, and documenting the delivery time. We interviewed all kitchen personnel responsible for brewing the coffee, checked the coffee machines for temperature, and prepared questions for the defense to use at the deposition. Those questions included, why was the child left alone?
